Key Coverage Enhancements in our Updated Contractors Pollution & Professional Liability Policy offering
By. R. Ivy Riggs, Director of Underwriting
We’re pleased to share several meaningful coverage enhancements in PartnerOne’s newest Contractors Pollution and Professional Liability Policy, form CPP 9000 07 26. Here’s a look at what’s improved and how these changes can benefit your clients.
Broader Subrogation Waiver Under Professional Liability
For the first time, the updated form includes a waiver of subrogation under Coverage A — Professional Liability. Where a written contract requires it, the insurer waives its right of recovery against specific additional insureds for damages arising from professional services performed on their behalf.
Expanded Definition of Insured Location
The 07 26 form broadens the definition of Insured Location to include property temporarily rented or leased by the Named Insured for the sole purpose of supporting covered operations or professional services for a third party. This is a practical improvement for contractors who routinely utilize temporary field offices, staging areas, or client-provided space during project execution.
New Products Liability Give-Back for Custom-Designed Products
The updated form adds a valuable exception to the Products Liability exclusion for custom, project-specific products while also retaining the existing exception for pollution conditions arising from the fabrication, assembly, or installation of products in connection with covered operations. This enhancement helps provide coverage for claims arising from negligent acts, errors, or omissions in the design of one-off products developed for a specific customer’s or project’s requirements, making the form particularly responsive to the exposures of specialty contractors and custom fabricators.
Coverage B.5 Defense Costs and Supplementary Payments No Longer Erode Limits
In the latest form, defense costs and miscellaneous claim-related payments, as defined in the policy, incurred under Coverage B.5 — Named Insured’s Locations — no longer reduce the available limits of insurance. This change means insureds with scheduled locations now have the full benefit of their coverage limits available for indemnity, with defense costs and supplementary payments sitting outside those limits.
Broader Additional Insured Scope Under Coverage B
The updated form extends additional insured status under Definition 17.i. to all of Coverage B, rather than limiting it to Coverages B.1, B.3, and B.4 as in the prior form. This change gives additional insureds broader protection across more coverage parts, including Transportation Pollution Liability and Named Insured’s Locations, better aligning with the contractual requirements of today’s construction projects.
These enhancements reflect our ongoing commitment to delivering a policy form that keeps pace with the evolving needs of contractors and the insurance professionals who work with them. If you have questions about how the CPP 9000 07 26 compares to the prior form, or how these changes apply to a specific account or submission, please don’t hesitate to reach out to your underwriter — we’re here to help.
